{"id":2532,"date":"2021-08-23T18:32:26","date_gmt":"2021-08-23T18:32:26","guid":{"rendered":"https:\/\/trademarkmanagement.com\/?p=2532"},"modified":"2021-08-23T18:32:30","modified_gmt":"2021-08-23T18:32:30","slug":"iron-maiden-settles-with-e-commerce-company-over-frozen-paypal-account","status":"publish","type":"post","link":"https:\/\/trademarkmanagement.com\/?p=2532","title":{"rendered":"Iron Maiden settles with e-commerce company over frozen PayPal account"},"content":{"rendered":"\n<h1 class=\"wp-block-heading\"><\/h1>\n\n\n\n<h3 class=\"wp-block-heading\">By&nbsp;<a href=\"https:\/\/completemusicupdate.com\/article\/author\/chriscooke\/\">Chris Cooke<\/a>&nbsp;| Published on Monday 23 August 2021<\/h3>\n\n\n\n<p><br>Iron Maiden have settled a lawsuit that was filed against them in Florida by an American e-commerce platform called Viral Style which accused one of the metal band\u2019s companies \u2013 and a law firm they worked with \u2013 of grabbing $200,000 from its PayPal account without permission in an act that was \u201cakin to a high-tech and sophisticated bank robbery\u201d.<\/p>\n\n\n\n<p>The dispute between Viral Style and Iron Maiden first began in the courts in Illinois, with the former getting caught up in a load of legal action pursued by the latter against a plethora of merch and clothing companies that were accused of infringing the band\u2019s intellectual property.<\/p>\n\n\n\n<p>Two of those accused infringers \u2013 Beatee and 89artshirt \u2013 used Viral Style\u2019s platform to sell their infringing products. However, Viral Style got itself removed from the band\u2019s litigation by successfully arguing that it was not actively involved in the production or distribution of any of its clients\u2019 merchandise, and as a passive platform had safe harbour protection from any liability for any infringement.<\/p>\n\n\n\n<p>However, Viral Style said&nbsp;<a href=\"https:\/\/completemusicupdate.com\/article\/iron-maiden-accused-of-misappropriating-200000-from-e-commerce-firms-paypal-account\/\">in its lawsuit in February<\/a>, despite being removed from all that legal action in Illinois, its PayPal account was still frozen by Maiden\u2019s company and AMS Law, and \u2013 subsequently \u2013 $200,000 was taken from said account. That action seemingly occurred because it was claimed that Viral Style shared a PayPal account with its two clients, something the e-commerce firm strongly denied.<\/p>\n\n\n\n<p>With all that PayPal shenanigans allegedly causing inconvenience, lost sales and reputation damage to Viral Style, it specifically sued Iron Maiden Holdings and AMS Law for fraud, tortious interference and civil conspiracy, seeking repayment of the $200,000 and damages.<\/p>\n\n\n\n<p><a href=\"https:\/\/completemusicupdate.com\/article\/iron-maiden-hit-back-at-e-commerce-firm-accusing-them-of-misappropriating-200000\/\">In April<\/a>, the band and the lawyers called for Viral Style\u2019s litigation to be dismissed, claiming that the lawsuit was \u201criddled with inconsistencies and contradictions\u201d. They also argued that the Florida courts didn\u2019t have jurisdiction over the dispute, because Maiden themselves are based in the UK, and AMS Law is located in Illinois, where the original legal action against Beatee and 89artshirt was instigated.<\/p>\n\n\n\n<p>Talks to settle the dispute had been ongoing in recent weeks and \u2013 while at one point it looked like those negotiations had faltered \u2013 on Friday the judge overseeing the lawsuit confirmed a settlement had now been reached.<\/p>\n\n\n\n<p>A court filing stated: \u201cMagistrate Judge Amanda Arnold Sansone announces a settlement of this action.
